Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Giordano Mosca ("Synctonia", "we", "us") governing your use of the Synctonia mobile app (the "App"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 16 years old to use Synctonia. By using the App you confirm that you meet this requirement and that the information you provide is accurate.
2. The service
Synctonia lets you identify music playing around you, see other people listening to the same track in real time, send reactions ("vibes"), match with others, and exchange messages in an ephemeral per-track chat. When you and another user vibe each other, you may unlock the contact details you each chose to share.
We may change, suspend, or discontinue features at any time.
3. Your account
You are responsible for your account and for keeping your credentials secure. You agree to provide accurate information and not to impersonate others or create accounts for abusive purposes.
4. Acceptable use
You agree not to use Synctonia to:
- harass, threaten, bully, stalk, or intimidate anyone;
- post or send content that is hateful, sexually explicit, violent, defamatory, or otherwise objectionable;
- share content that is illegal, infringes others' rights, or violates anyone's privacy;
- impersonate any person or misrepresent your identity;
- send spam, scams, or unsolicited promotions;
- attempt to access, disrupt, or reverse-engineer the service, or use it through bots or automated means;
- collect or misuse other users' data, including contact details shared after a match.
5. Objectionable content and abusive users
- You can block any user, so you no longer see each other or interact.
- You can report any user or content directly in the App.
- We review reports and may remove content, restrict features, or suspend/terminate accounts that violate these Terms, where feasible within 24 hours of a valid report.
By using the App you acknowledge that other users generate content and that we are not responsible for that content, though we act on reports as described above.
6. Your content
You keep ownership of the content you create (e.g., your profile, messages). You grant us a limited, non-exclusive license to host, display, and transmit it solely to operate the App. You are solely responsible for the content you share and for the consequences of sharing it, including any contact details you choose to reveal.
7. Microphone and permissions
The App uses your microphone only while you tap to identify a song (about 6 seconds) and does not listen in the background. You can manage permissions at any time in your device settings. See our Privacy Policy for details.
8. Third-party services and music
Synctonia relies on third-party services (including our music-recognition provider and hosting infrastructure). Recognized track metadata and album artwork are provided by third parties and may be inaccurate or incomplete. Synctonia does not host, stream, or grant rights to any music recordings; it only identifies tracks.
9. Disclaimers
The App is provided "as is" and "as available", without warranties of any kind. We do not guarantee that song recognition will be accurate, that the service will be uninterrupted or error-free, or that you will find matches or other users.
10. Limitation of liability
To the maximum extent permitted by law, Synctonia and its operators will not be liable for any indirect, incidental, or consequential damages, or for interactions between users. Nothing in these Terms limits liability that cannot be limited by law.
11. Termination
You may stop using the App and delete your account at any time (Profile - Delete Account). We may suspend or terminate your access if you violate these Terms or to protect the service and its users.
12. Governing law
These Terms are governed by the laws of Italy, without regard to conflict-of-law rules. Mandatory consumer-protection rights in your country of residence remain unaffected.
13. Changes to these Terms
We may update these Terms. We will post the updated version here and update the "Last updated" date. Continued use of the App after changes means you accept the updated Terms.

I presenti Termini di Servizio ("Termini") costituiscono un accordo legale tra te e [Ragione sociale / nome completo] ("Synctonia", "noi") che disciplina l'utilizzo dell'app mobile Synctonia (l'"App"). Creando un account o utilizzando l'App, accetti questi Termini. Se non li accetti, non utilizzare l'App.
1. Requisiti di accesso
Devi avere almeno 16 anni per utilizzare Synctonia. Utilizzando l'App confermi di soddisfare questo requisito e che le informazioni fornite sono accurate.
2. Il servizio
Synctonia ti permette di identificare la musica che suona intorno a te, vedere in tempo reale chi ascolta lo stesso brano, inviare reazioni ("vibe"), fare match e scambiare messaggi in una chat effimera per brano. Quando tu e un altro utente vi mandate vibe a vicenda, potete sbloccare i contatti che ciascuno ha scelto di condividere.
Potremmo modificare, sospendere o interrompere funzionalita in qualsiasi momento.
3. Il tuo account
Sei responsabile del tuo account e della sicurezza delle tue credenziali. Accetti di fornire informazioni accurate e di non impersonare altri o creare account per scopi abusivi.
4. Uso accettabile
Accetti di non utilizzare Synctonia per:
- molestare, minacciare, intimidire o stalkerare chiunque;
- pubblicare o inviare contenuti offensivi, sessualmente espliciti, violenti, diffamatori o altrimenti inappropriati;
- condividere contenuti illegali, che violano diritti altrui o la privacy di terzi;
- impersonare qualsiasi persona o falsificare la propria identita;
- inviare spam, truffe o promozioni non richieste;
- tentare di accedere, disturbare o fare reverse engineering del servizio, o utilizzarlo tramite bot o strumenti automatizzati;
- raccogliere o utilizzare in modo improprio i dati di altri utenti, inclusi i contatti condivisi dopo un match.
5. Contenuti inappropriati e utenti abusivi
- Puoi bloccare qualsiasi utente, in modo da non vedervi e non interagire piu.
- Puoi segnalare qualsiasi utente o contenuto direttamente nell'App.
- Esaminiamo le segnalazioni e possiamo rimuovere contenuti, limitare funzionalita o sospendere/terminare account che violano questi Termini, ove possibile entro 24 ore da una segnalazione valida.
Utilizzando l'App riconosci che altri utenti generano contenuti e che non siamo responsabili di tali contenuti, sebbene agiamo sulle segnalazioni come descritto sopra.
6. I tuoi contenuti
Mantieni la proprieta dei contenuti che crei (es. profilo, messaggi). Ci concedi una licenza limitata e non esclusiva per ospitarli, visualizzarli e trasmetterli al solo fine di gestire l'App. Sei l'unico responsabile dei contenuti che condividi e delle conseguenze della loro condivisione, inclusi i contatti che scegli di rivelare.
7. Microfono e autorizzazioni
L'App utilizza il microfono solo mentre tocchi per identificare una canzone (circa 6 secondi) e non ascolta in background. Puoi gestire le autorizzazioni in qualsiasi momento nelle impostazioni del dispositivo. Consulta la nostra Informativa sulla Privacy per i dettagli.
8. Servizi di terze parti e musica
Synctonia si avvale di servizi di terze parti (tra cui il provider di riconoscimento musicale e l'infrastruttura di hosting). I metadati dei brani riconosciuti e le copertine degli album sono forniti da terzi e potrebbero essere imprecisi o incompleti. Synctonia non ospita, trasmette o concede diritti su registrazioni musicali; si limita a identificarle.
9. Esclusioni di garanzia
L'App e fornita "cosi com'e" e "secondo disponibilita", senza garanzie di alcun tipo. Non garantiamo l'accuratezza del riconoscimento brani, la continuita o l'assenza di errori del servizio, ne che troverai match o altri utenti.
10. Limitazione di responsabilita
Nella misura massima consentita dalla legge, Synctonia e i suoi gestori non saranno responsabili per danni indiretti, accidentali o consequenziali, ne per le interazioni tra utenti. Nulla nei presenti Termini limita la responsabilita che non puo essere limitata per legge.
11. Risoluzione
Puoi smettere di usare l'App ed eliminare il tuo account in qualsiasi momento (Profilo - Elimina account). Potremmo sospendere o terminare il tuo accesso in caso di violazione dei Termini o per proteggere il servizio e i suoi utenti.
12. Legge applicabile
I presenti Termini sono disciplinati dalla legge italiana, senza riguardo alle norme sui conflitti di legge. I diritti inderogabili di protezione dei consumatori nel tuo paese di residenza rimangono impregiudicati.
13. Modifiche ai Termini
Potremmo aggiornare questi Termini. Pubblicheremo la versione aggiornata qui e aggiorneremo la data. L'utilizzo continuato dell'App dopo le modifiche implica l'accettazione dei Termini aggiornati.
